These Terms and Conditions ("Terms") govern the provision of window and door replacement, sales, and installation services by Flower Mound Window Replacement ("Company," "we," "us," or "our") to the customer ("Client" or "you"). By requesting an estimate, scheduling a consultation, or entering into a service agreement with us, you agree to be bound by these Terms.
1. Services Provided and Scope of Work
Flower Mound Window Replacement provides comprehensive services including, but not limited to:
- Consultation and Estimation: Providing professional advice, product selection guidance, and detailed written estimates for the project.
- Product Sales: Supplying new windows, doors, and related materials.
- Installation: Professional removal of existing units and installation of new windows and doors at the Client's specified property.
- Scope of Agreement: The final price and project description are based strictly on the detailed scope of work outlined in the written estimate or contract. Any deviations or additional work requested by the Client must be documented via a signed Change Order and may result in adjusted charges and timelines.
2. Estimates, Pricing, and Payments
- Estimate Validity: All written estimates are valid for a period of 30 days from the date of issuance. Pricing is subject to change thereafter due to material cost volatility.
- Deposit Requirement: A non-refundable deposit, typically 50% of the total project cost, is required to confirm the order, authorize the purchase of custom materials (windows/doors), and secure the installation date.
- Custom Order Policy: Since all windows and doors are custom-ordered based on site measurements, once the deposit is paid and the order is placed with the manufacturer, the order cannot be canceled or modified without the Client being fully responsible for the cost of the materials.
- Final Payment: The remaining balance is due in full immediately upon the completion of the installation and the Client's final inspection of the work.
- Late Payments: Invoices not paid within the agreed-upon terms may incur a late payment fee of 1.5% per month on the outstanding balance, or the maximum rate permitted by Texas law.
3. Cancellation and Refunds
- Cancellation Before Order: If the Client cancels the contract before the custom windows or doors have been ordered from the manufacturer, the deposit will be returned, minus any costs incurred for site measurements, surveys, or design work completed.
- Cancellation After Order: If the Client cancels after the custom order has been placed, the deposit is non-refundable as it is used to cover the expense of the custom materials.
4. Installation and Project Conditions
- Scheduling and Delays: Installation dates are provided as good-faith estimates. We are not liable for delays caused by factors outside our control, including manufacturer lead times, shipping interruptions, or adverse weather conditions. We will communicate any delays promptly.
- Client Responsibilities: The Client is responsible for:
- Preparation: Removing all personal items, window treatments (blinds, curtains), and furniture from the interior and exterior work areas to allow clear access.
- Utilities: Ensuring access to necessary utilities (electricity and water) at the property.
- Homeowner's Association (HOA): The Client is responsible for reviewing and obtaining any necessary approvals from their HOA regarding the style, color, or installation of the new windows or doors prior to installation.
- Damage and Protection: We take reasonable precautions to protect the property. We are not responsible for damage to items or surfaces that the Client failed to remove from the immediate work zone. While we minimize debris, the Client acknowledges that some dust and minor scuffs are inherent to construction work.
5. Warranty and Liability
- Manufacturer Warranty: All products (windows and doors) are covered by the original manufacturer's warranty. We will provide documentation outlining the specific terms and duration.
- Workmanship Warranty: We offer a one-year limited warranty on the quality of our installation workmanship, effective from the date of completion. This covers defects that result directly from improper installation (e.g., air or water infiltration due to sealing errors).
- Warranty Exclusions: Our warranty does not cover:
- Damage caused by misuse, abuse, neglect, accident, or acts of nature (e.g., hail, high winds).
- Normal wear and tear, fading, or minor thermal imperfections.
- Damage resulting from structural movement, foundation issues, or subsequent work performed by others.
6. Governing Law and Contact Information
These Terms shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes shall be resolved in the courts located in Denton County, Texas.
